Full Rental Agreement

GENERAL CONDITIONS

OWNER shall provide all utilities, furnishings, towels and bathroom and kitchen supplies. GUEST agrees to leave the property in the same condition as found and to return keys upon departure. There is a $50 fee for non-returned/lost keys. GUEST agrees to inform all members of the rental party and visiting guests (if any) of all conditions, guidelines, recommendations and restrictions contained herein, and to enforce same.

Violation of any portion of this agreement is grounds for immediate termination and eviction.

If any item or portion of this agreement is found to be illegal or unenforceable, the remainder of this agreement will remain binding to both parties.

EARLY DEPARTURES

In the event that GUEST departs earlier than scheduled checkout, remaining nights will not be refunded. A refund will be issued GUEST for any nights OWNER is able to re-rent the unused nights from early departure with another guest to the extent that the re-rented amount equals the cancelled rental amount.

CANCELLATION BY GUEST AND REFUND POLICY

If the canceled period is re-rented, any rent paid will be refunded to the extent that the re-rented amount covers the cancelled rental amount. (For example, If OWNER discounts in order to re- rent on short notice, or incurs commission costs from rental agents, or re-rent is for fewer nights during the original rental period, refund will be offset by these costs.) In no event will a refund be greater than the amount paid. No-shows, late arrivals or early departures, are non-refundable.

NUMBER OF RESIDING GUESTS

The number of GUESTS shall not exceed the number of GUESTS on this rental agreement. (Up to two persons are allowed). If more people occupy premises GUEST agrees to pay for the additional people ($25 per night per person).

NUMBER OF DAY VISITORS

The rental is made primarily for the use and enjoyment of the GUESTS listed on page #1. For any gathering of additional GUESTS (day visitors to the premises) GUEST shall obtain OWNER'S prior approval anytime the total number of persons at the premises exceeds (or is likely to exceed) four (4). Any planning for "events" such as weddings, wedding receptions, birthday parties, etc., shall be contingent on OWNER'S prior approval. Maximum number of persons at the premises shall in no event exceed 8. The utmost consideration shall be given to neighbors. At no time shall any visitor or GUEST block or partially block the road. At no time I shall any visitor or GUEST allow or create noise nuisance (music, amplified voices, loud voices, horseplay) after 9:00pm. All neighbors shall be entitled to quiet enjoyment of their homes 24 hours a day.

LIABILITY

OWNER assumes no liability or responsibility for any claims, expenses, financial or property loss or damage, arising from injury, accident, death, delay, alteration or inconvenience, by whatever cause including airline scheduling, default, strike, terrorism, war, hostility, civil disturbance, quarantine, or resulting directly or indirectly from acts of god. OWNER assumes no liability or responsibility for injury, accidents or death involving any accidents, injury, or death on the premises or in the area. GUEST is responsible for the premises and for his/her/their guests during occupancy of the property. GUEST agrees to inform all members of the rental party and any invitees or visitors of all conditions, guidelines, and restrictions and recommendations contained herein, and to enforce the same.

ZERO TOLERANCE / ILLEGAL SUBSTANCES OR ACTIVITIES

GUEST and the members of his/her party shall not use or permit to be brought onto the property any illegal or controlled substances (without prescription), firearms, or items hazardous to persons or property. GUEST agrees that the premises shall not be used for any illegal or unlawful purpose.

SMOKING

Is not permitted in the house or on the premises. Violation is grounds for immediate termination with no refunds or rent or deposit.

QUIET USE OF THE PREMISES

The property is located in a residential neighborhood. GUEST shall be quiet and peacefully enjoy the premises so as not disturb neighbors or visitors, guests of neighboring properties. This is especially appreciated after 9:00 PM. Occupancy and use of the premises in such a fashion that disturbs or offends neighboring residents or guests shall be deemed grounds for termination. We wish you to have an enjoyable vacation, but you must respect the rights of our neighbors.

TRIP INSURANCE

OWNER strongly recommends that GUEST purchase trip cancellation and interruption insurance. OWNER'S Google search for "Trip insurance" returned the following links (and many more):

PETS

Pets are not permitted in/at the property. Violation is grounds for immediate termination with no refunds of rent or deposit. OWNER may, at OWNER'S sole discretion make exception to this policy. In this case, an additional rental fee, security deposit and cleaning fee applies and pet agreement must be executed within the contract.

ALL RENTALS ARE TO FAMILIES AND RESPONSIBLE ADULTS ONLY

No high school, college or civic groups, chaperoned or not, are permitted. Tenant acknowledges that he/she will personally occupy the property for the entire lease period and will not sublet any portion of the property.

CHECK IN

After 4:00 P. M. on the arrival date.

CHECK OUT

On the date of departure will be by 10:00 A.M. If you need a later check-out please let OWNER know, and we will try to accommodate your schedule.

APPLIANCE and/or SYSTEM MALFUNCTIONS

Service requests for televisions, stereos, CD/DVD/VCR recorders/players, fax machine, appliances, plumbing fixtures, lighting and other electrical fixtures etc., will be responded to as quickly as possible. There are no rebates or refunds issued to GUESTS for any reason related to mechanical/electrical malfunction. Electrical, telephone, cable, broadband outages are uncommon, but not unheard of-- no rebate or refund will be issued because of them.

BROADBAND INTERNET CONNECTION

Wifi (wireless internet) is included as a courtesy. GUEST is responsible for necessary knowledge and set up of their personal computer to access the wireless internet connection. No technical support is offered by OWNER.

CARE OF PROPERTY

GUEST is expected to care for the property as if it were their own. Tenant acknowledges that unless OWNER is notified on day of check-in of any damage or cleaning concerns, then thereafter, all damages or cleaning concerns will be deemed the responsibility of GUEST, and must be reported to OWNER and paid for prior to departure, and GUEST agrees to forfeit security deposit (or pay amounts greater than security deposit) for said damage and/or cleaning concerns.

TELEPHONES

A landline is provided at the desk. GUEST may make unlimited calls within the local area. Calls out side of the local area or information request calls are additional and GUEST is expected to use their calling card and/or cell phone. Long distance calls placed by GUEST on landline will be billed to GUEST at a rate of $0.15 per minute after checkout. 411 calls placed by GUEST will be billed to GUEST at a rate of $1.00 per call.

LOCKED AREAS

Areas for which Tenant is not provided a key, such as garage, OWNER'S personal storage areas, are exempt from this rental agreement and are off limits to the GUEST. Forced entry into these areas is cause for immediate termination and GUEST will be charged for damage and/or missing items.

CANCELLATION BY OWNER

In the event that the OWNER is unable to deliver said property to GUEST under this lease agreement prior to or during occupancy because of fire, eminent domain, act of nature, double booking, delay in construction or any other reason whatsoever, GUEST hereby agrees that OWNER'S sole liability as a result of these conditions is a full refund of all consideration previously tendered by GUEST. Pursuant to the terms of this rental agreement, GUEST expressly acknowledges that in no event shall OWNER be held liable for any consequential or secondary damages, including but not limits to, any expenses incurred as a result of moving for any damage, destruction or loss.

LOST, STOLEN OR ABANDONED ARTICLES

OWNER shall have no responsibility for lost, stolen or abandoned items. There will be a fee of $25.00 plus shipping for any returned items.

SECURITY

GUEST acknowledges that OWNER has made no representation that the property is a "secure" compound, and that GUEST is safe from theft, injury or damage. Gates, fences and locks are provided primarily for the protection of OWNER'S property and are not a warranty of protection nor are they specifically provided for the protection of GUEST or GUEST'S property. GUESTS shall take appropriate measures to protect themselves and their own property, and report to the Police any suspicious activities, persons or events occurring on or about the general premises.

INDEMNITY

The GUEST agrees to release, indemnify and defend the OWNER and his care-taker from and against all liability, should anyone be injured or die upon the premises during the term of the rental, resulting form any cause whatsoever.

MINIMUM AGE

OWNER will rent to persons 24 years of age or older only. Minors must be chaperoned at all times or GUEST is subject to immediate eviction. OWNER reserves the right to check ID's to verify age.

GARBAGE

Garbage bags are provided. Garbage pickup occurs on Thursday mornings. Large green dumpsters are provided in the alleyway for garbage.
